PESHAWAR: The Peshawar High Court (PHC) on Thursday dismissed the petition filed by the candidates who had failed to qualify the Provincial Management Services (PMS) examination and took back the earlier order of staying the appointment of the officer declared successful.
A two members bench of the PHC consisting of Justice Ijaz Anwar and Justice Shakil Ahmed heard the petition. The counsels for the petitioners told the court that the Provincial Public Service Commission (PPSC) had announced the date for the grade-17 test in the year 2020. He said 6000 candidates appeared in the test of which 226 passed the written examination. The lawyers for the petitioners said 77 candidates who appeared in the psychological tests were not given any marks. They said among those who were given zero marks were the one who had allegedly topped the written exam and others.
The counsels said the PPSC had recommended for appointment names of the 149 candidates to the KP government. The lawyers for the PMS-qualified candidates told the court everything was done as per the law.
The PPSC counsel said every candidate was required to secure 120 marks as per the rule. He or she would be considered failed even if 119 marks were obtained. The lawyer for the PPSC said that the Supreme Court of Pakistan had declared that high courts could not interfere in the interview process.
The PHC bench rejected the petition by the failed candidates and upheld the recommendation of the PPSC for the appointment of qualified candidates.
