LAHORE: The Lahore High Court (LHC) on Friday declared illegal marriage with the sister of wife without completing iddat period.
Justice Tariq Saleem Sheikh issued 11-page written order.
The decision issued by the court said marrying sister of wife during the iddat period is tantamount to keeping two sisters under nikkah simultaneously.
It further said that one man cannot keep two sisters in his nikkah at a time. The Ulema have agreed that marriage cannot take place with the sister of wife during iddat period.
The court said in its order that no one can marry the sister of his wife without completion of iddat period of his first wife.
“If husband and wife don’t abolish such marriage, then it is responsibility of the Qazi to abolish this marriage,” the court said. The court said that petitioner Musawwar Hussain resorted to court for bail before arrest.
