PESHAWAR: The additional district and sessions judge on Wednesday suspended the sentence of a man, who had been awarded three-month imprisonment and fined Rs5,000 for contracting a second marriage without the permission of his first wife.
The additional district and session judge, Syed Badshah, suspended the sentence awarded to Sajjad Khan, a resident of Peshawar, on appeal and issued notices to the respondents in the case. The court issued the relevant officials to produce the record of the case till April 30 and adjourned the proceedings.
His lawyer Ahmad Saleem told the court that the family court had convicted his client of contracting a second marriage without the permission of his first wife and sentenced him to three-month imprisonment and fined Rs5,000.
He said that the complainant had not filed the complaint herself, rather it was submitted by her brother. He said that sentencing his client was against the Sharia law and Islamic principles, requesting the court to suspend his sentence.
The family court had sentenced the man to three-month in prison and fined Rs5,000 for contracting the second marriage without the permission of his first wife under Section 6, Clause 5 of the Muslim Family Laws Ordinance 1961.
